MBALE CITY, Uganda [ SHIFT MEDIA NEWS]  The Elgon Region police in Mbale are currently investigating allegations of fraud involving the National Resistance Movement (NRM) chairperson for Mbale district, Muhamoud Masaba Mutenyo . The allegations stem from a complaint lodged by Eng. Stanley Watenga, who accuses Masaba of obtaining UGX 150 million from him under false pretenses. The matter, which has captured public attention in Mbale city, highlights concerns about accountability within local leadership circles.

The Allegations

Eng. Stanley Watenga, a prominent figure in the region, alleges that in 2022, Masaba approached him with an enticing proposal to purchase a prime plot of land in Mbale city. According to Watenga, Masaba claimed ownership of the land, that was allegedly donated by President Museveni and assured him that the transaction would be legitimate and swift. Trusting the NRM chairperson’s influence and reputation, Watenga transferred UGX 150 million to Masaba in good faith.

However, Watenga says the promise of land ownership never materialised. Repeated attempts to follow up with Masaba were allegedly met with excuses and delays. Realising that the deal might not be genuine, Watenga sought legal recourse, reporting the matter to the Elgon Region police Vide CRB 187/2024.

“I trusted him because of his status and reputation, but I’ve been left disappointed. He took my money and failed to deliver what he promised,” Watenga said during an interview. He added that he has provided documentary evidence, including transaction records and communication, to the police to substantiate his claims.

Police Involvement

The Elgon Region police have since taken up the matter and launched an investigation. According to Regional CID officer, Masaba is being investigated for obtaining money by false pretenses, a criminal offense under Ugandan law.

“Yes it is true we are investigating Mr. Masaba for obtaining money by false pretense. He was summoned here and he sent his lawyers. He acknowledged receiving the said monies and committed to refund though his mode of payment is sluggish,” said the officer during at interview at his Mbale offices on Saturday.

The Regional CID boss said that statements were being recorded from both parties. “We have received the complaint from Eng. Watenga, and we are investigating the matter. As of now, we cannot divulge more details, but the case is being handled in accordance with the law,” the officer said.

The police are reportedly examining key pieces of evidence, including financial records and communication between the two parties. Efforts to recover the money or establish whether the land transaction was fraudulent are ongoing.

Masaba’s Response

Attempts to reach Mahmoud Masaba for comment have so far been unsuccessful. While the NRM chairperson has not publicly responded to the allegations, sources close to him suggest he took the money. Some members of the local NRM leadership are against Masaba’s action descrbing it as an embarrassment and shame to the ruling party.

However, critics argue that Masaba’s position as a senior figure within the NRM should not exempt him from accountability. Calls for transparency and swift justice have been growing louder, with residents of Mbale city demanding that the matter be resolved impartially.

Public Reaction and Implications

The case has sparked widespread debate in Mbale city and beyond, with many questioning the integrity of leaders entrusted with public trust. Some residents view the allegations as a reflection of a broader problem of corruption and misuse of power among local officials.

“Leaders should be role models, not people who exploit others for personal gain,” said one Mbale resident. “This case is about more than just UGX 150 million; it’s about holding leaders accountable.”

The scandal also raises concerns about the potential damage to the NRM’s reputation in the Elgon Region. The party, which has long dominated the political landscape in Uganda, faces increasing scrutiny over the conduct of its members.

Legal Perspective

Under Ugandan law, obtaining money by false pretenses is a serious offense that can attract significant penalties if proven. According to Section 305 of the Penal Code Act, the crime involves deliberately deceiving another person to obtain property, money, or services. If convicted, Masaba could face imprisonment, fines, or both.

Legal analysts emphasize that the case will hinge on the evidence presented by both parties. Key questions include whether Masaba genuinely owned the land he promised to sell and whether there was a deliberate intention to defraud Watenga.

“This is a straightforward case of alleged fraud, but it will depend on the evidence the complainant can provide,” said one legal expert familiar with such cases. “The authorities must ensure a fair and thorough investigation.”

As the investigation unfolds, the case serves as a critical test of the justice system’s ability to hold influential individuals accountable. For Eng. Stanley Watenga, the matter is about seeking justice and recovering his lost funds. For the public, it is a reminder of the importance of integrity in leadership and the need to address corruption at all levels.

Seeking Resolution

Despite the challenges, Watenga remains steadfast in him pursuit of justice. He is calling for the politician to refund his money immediately. Additionally, he is urging the police to fulfill their mandate by conducting a thorough and impartial investigation.

“I’m not asking for special treatment,” Watenga said. “I’m simply asking for what is rightfully mine. The law should apply equally to everyone, regardless of their position or influence.”
